These terms and conditions of sale apply to all contracts concluded between, on the one hand, Hoodielash, whose operational headquarters are located in Ixelles, Belgium, registered with the Crossroads Bank for Enterprises under number 0755.483.015, hereinafter referred to as "the seller," and, on the other hand, any person wishing to make a purchase via the seller's website, hereinafter referred to as "the buyer."

Definitions

Buyer: Any natural person of legal age and full legal capacity, or the legal representative of such a person. In this latter case, the legal representative is bound by these general conditions.

Consumer: Any natural person who acquires or uses products marketed for purposes that exclude professional or commercial use.

Professional Buyer: Any individual or legal entity not meeting the definition of a consumer as stated above.
1. Purpose
These general terms and conditions (hereinafter referred to as “General Terms – G.T.”) are applicable to all orders placed by "buyers" (individuals or professionals, domestic or foreign) and Malou VDC, headquartered at Avenue Louise, 367, Brussels, registered with the Crossroads Bank for Enterprises under number BE0755483015, hereinafter referred to as “the seller.”
These terms aim to define the contractual relationship between the seller and the buyer as well as the conditions applicable to all purchases made via the seller's website.
By confirming an order via the seller’s website, the buyer explicitly acknowledges having read, understood, and accepted these general conditions, which are required for any order made through the website. These terms may be saved or printed by the buyer.
Any non-expressly agreed-upon changes are not applicable. Only written deviations agreed upon by the seller may modify these general terms. The seller reserves the right to amend these terms at any time. The terms applicable to an order are those in force at the time of the order’s confirmation.
In the event of a conflict between the general conditions of a contracting party and these terms, only the seller's terms shall apply.
2. Products
Unless otherwise stated in writing, the products offered on the seller's website are those listed at the time of order and subject to stock availability.
3. Orders
An order is only binding upon the seller once it has been confirmed in writing by email. Samples and other free offers advertised before the order are limited to available stock. The seller is not responsible for unavailable items.
Changes made by the buyer to their order or the seller's offer are only valid if accepted and confirmed in writing by the seller.
For unilateral cancellations of an order by a professional buyer, the seller reserves the right to claim compensation equal to 50% of the total order value.
4. Order Confirmation
Once an order has been validated and payment completed, the buyer will receive an order confirmation email along with a summary of the validated products. The seller will then process the shipment.
For an order to be valid, the buyer must:

Complete the identification form or provide a customer number if available.

Fill in the online order form with all product or service references.

Verify and validate their order.

Acknowledge and accept the general terms of sale.

Make payment as outlined.

Confirm the order and payment.
Orders are deemed finalized upon confirmation by the buyer. No shipment will occur without order confirmation and full payment. If an item is unavailable, the seller will notify the buyer via email, offering the option to wait for restocking, cancel the unavailable items, or receive a refund for the unavailable products.
If a kit contains unavailable items, the buyer may request a refund for the missing item(s) or exchange them for equivalent products.
5. Delivery Times
Orders are dispatched within 24-72 hours. However, certain situations may exempt the seller and buyer from adherence to these deadlines, including:

Force majeure (e.g., strikes, technical incidents, natural disasters, pandemics, etc.).

Non-compliance with payment terms.

Missing information needed to process the order.
6. Shipping and Transportation
Products are delivered to the address provided by the buyer. The seller is not responsible for delivery delays or errors due to incorrect information provided by the buyer.
For professional buyers, transportation risks are borne by the buyer. Upon delivery, the buyer must verify that the products match the order. In case of missing, damaged, or incorrect items, the buyer must contact customer service within five days via email at contact@hoodielash.com.
For damaged orders due to shipping, the seller is not responsible and is not obligated to issue a refund. International buyers may incur customs fees, which the seller will not refund.
7. Right of Withdrawal
Consumers have a 14-day withdrawal period starting the day after delivery, without reason or additional charges.
Within this period, buyers must notify the seller of their decision via email (contact@hoodielash.com) or postal mail. The seller will refund payments received, including delivery costs, without undue delay. Return shipping is at the buyer's expense, and products must be returned in their original packaging, complete and undamaged.
8. Pricing
Prices are stated in euros, inclusive of all taxes (TTC). Prices are subject to change, but the price at the time of the order applies.
9. Payment
The seller accepts the following payment methods:

Credit card (VISA, MasterCard, American Express) via the secure STRIPE platform.

PayPal (with or without an account).

Bancontact.
9.1 Promotional Codes
Promotional codes apply to listed items, subject to availability, and are non-refundable or transferable. Codes cannot be combined and are valid for new orders only.
10. Warranty for Non-Professional Buyers
Consumers are entitled to a legal warranty under the law of March 20, 2022. Any non-conformity must be reported within two months of receiving the order.
The warranty excludes defects due to misuse (e.g., water damage, oxidation, or wear). Proof of purchase is required.
11. Data Protection
The seller strictly uses personal data for order processing and complies with GDPR and relevant legal regulations.
12. Liability
The seller is only obligated to reasonable means and is not liable for internet-related damages, payment issues, or misuse of products.
13. Intellectual Property
All website elements are the exclusive intellectual property of the seller. Unauthorized use or reproduction is prohibited.
14. Disputes
These terms are governed by Belgian law. Disputes will be resolved by the competent courts of Brussels. Alternative dispute resolution methods are available via this link.
